KALISPELL – The teenager who allegedly broke into a Kalispell family’s home in December and stabbed a Flathead High School teacher pleaded not guilty Thursday to three felony offenses, including attempted murder.

Dante Kirpal Kier, 19, appeared for the arraignment hearing in Flathead County District Court. The hearing had twice been postponed until Kier could be evaluated by a mental health professional, who recently determined that he is competent to stand trial. Kier faces charges of attempted deliberate homicide, aggravated burglary and assault with a weapon.

The charges relate to a Dec. 12 home invasion in southeast Kalispell, during which high-school teacher Brian Bay was stabbed. According to court records, Kier admitted to the crime, telling investigators with the Kalispell Police Department that he broke into the residence intent on killing the homeowner because “it felt good.”

Records state that Bay was fixing a dishwasher at the time of the burglary and went into his garage to retrieve a tool; when he went back inside the home, he found Kier in the hallway holding a wooden-handled steak knife.

The homeowner confronted Kier but the intruder allegedly stabbed him in the upper arm and inside the mouth. He also tried stabbing Bay in the ribs “numerous times,” but the man wrestled Kier to the ground while his wife called police. The couple’s children were also home but were not injured. Bay was treated at Kalispell Regional Medical Center and released.

Kier grew up in the Kalispell area, but until recently had been living in Santa Barbara, Calif., where he has a criminal conviction for entering a non-commercial dwelling in 2010. He returned to the Flathead Valley last fall to reconcile with his mother.

Kier’s father, George Kier, said his son has a history of mental illness and was living at a psychiatric hospital in California shortly before returning to Montana. ( WHY ARE HIS PARENTS LETTING A PERSON WITH MENTAL ILLNESS LISTEN TO ICP – BAD PARENTS)

In the weeks leading up to his arrest, Kier’s psychotic behavior had been escalating, his father said, and resulted in a 72-hour commitment to Pathways Treatment Center in Kalispell. He was also arrested for misdemeanor disorderly conduct.

Kier’s mother and stepfather obtained orders of protection against the teen because he threatened to kill them, according to Kier’s mother, who asked that her name not be published.

Police officers canvassed the neighborhood after the home invasion and spoke with several neighbors who reported finding notes on their windows that stated “your house is being watched tonight by … the creeps.”

Kier also claimed to be a member of the Insane Clown Posse gang and referred to himself as a Juggalo, court records state. According to the FBI’s 2011 National Gang Threat Assessment report, the Juggalos pay homage to the Detroit-based hip-hop group Insane Clown Posse and have recently been classified as a gang. The band is not associated with the gang.

Kier, who was staying at the Outlaw Hotel in Kalispell at the time of the alleged offense, remains in custody at the Flathead County Detention Center.

If convicted of attempted deliberate homicide, he faces a maximum punishment of life imprisonment.

Juggalo Suspect in Selah assault could face third strike

YAKIMA, Wash. — Prosecutors have filed a second-degree assault charge against a Yakima man accused of beating a Selah man, leaving him in a coma last weekend.

Patrick Paul Elledge, 31, is scheduled for arraignment Sept. 15 in the case, which could put him away for life as a persistent offender under Washington’s three-strikes law.

The case involves 50-year-old Selah resident Phillip Kennedy, who was found nearly beaten to death in his home on South Fifth Street last Sunday. He remained in a coma Friday.

Police say Kennedy’s girlfriend told them Elledge forced her to let him into the couple’s home Friday night, Aug. 27, and told her not to come back for 24 hours.

The motive for the attack appears to be a property dispute, police said. However, the case remains under investigation.

Known as “Sir Patrick, the Irish Juggalo,” Elledge has a lengthy criminal record that includes prison time for the robbery of a Yakima convenience store in 2005.

At that time, authorities said Elledge’s plea in the convenience store robbery counted as strike two under the state’s three-strikes-you’re-out law.

The Tulsa World, lead newspaper in a town evidently so rife with Juggalo-related mayhem that it is home to an Anti-Juggalo League, picks up Davis’s tale:

The hit-and-run incident occurred around 10 p.m. Tuesday as the victim was walking in the 3800 Block of Ohio Avenue in northeast Bartlesville, a court affidavit stated.
Witnesses told police they saw a man wearing black and white face paint driving a black sedan swerve across the road where the victim was walking, striking him and dragging him down the street, all the while yelling along with a passenger in the car.

The victim, who suffered multiple abrasions across his body, was taken by ambulance to Jane Phillips Medical Center in Bartlesville.

Davis claims that he was merely accelerating his vehicle to get away from an assailant who had punched him through his car window earlier, and indeed, it does look as if someone was not particularly down with this clown. If you look closely under that panda-looking face paint, it does appear that this Juggalo’s got a shiner.

Hell, maybe Davis was a randomly selected target in someone’s own Punch a Juggalo Day celebration.

What Happens when a juggalo commits a crime – responses from juggalo

It’s a given that every time one of these news articles appears about juggalos involved in some murder or other violent crime, one of the first juggalo rebuttals is along the lines suggesting juggalos are simply fans, claiming that it is unfair to label them as a gang when so many other organized groups such as sports fans meet the same criteria…

This mindset only serves to demonstrate the ignorance of juggalos. Please show me the news stories about a sports fan club member or similar group violently murdering innocent victims in the manner juggalos have been involved with (I find comparison to law enforcement groups particularly amusing).

The simple fact is that juggalos are labeled as a gang because members identifying themselves as such are repeatedly involved in criminal activity with alarming frequency. This is direclty related to the iconolgy of this media attracting individuals with predispositions to violence or other antisocial behavior. Certainly, many people enjoy a good horror movie; but when an individual becomes so obsessed with this type of imagery, immersing themselves within it on a full time basis, that is a flag that person is mentally troubled.

Juggalo – Trial date delayed in construction site murder case

Opening statements have been delayed in the trial for two men accused of beating another man to death at a Seattle construction site more than two years ago, according to a Law Clerk for King County Superior Court Judge Catherine Shaffer.

The decision was made at a scheduling conference for Steven Douglas Bauder, 22, of Federal Way, and Marcus David Dennis, 20, a transient from Crescent, Iowa,who have both been charged with first-degree murder.

Pre-trial motions are expected to begin on September 20 before Judge Shaffer at the King County Courthouse, courtroom W-829.

Opening statements are expected on September 27, according to the King County Prosecutor’s web site.
The conferences in the coming days will help the judge sort out further scheduling, pre-trial motions and hopefully a date for opening statements, said Dan Donohoe, press secretary for the King County Prosecutor’s Office.

Bauder and Dennis are accused beating of Noel Richard Lopez, 25, originally from Odessa, Texas, to death with “several broken … two by fours, large metal construction supports called prop heads, a wooden support, a metal bar and a metal ratchet type tool,” according to charging documents obtained by The Examiner.

The King County Medical Examiner autopsy revealed that Lopez had “suffered several deep lacerations from blunt force trauma to his face and head,” charging documents said.

“The left side of his torso was covered in bruises, and he had fractured ribs on both sides of his body,” charging documents state. “One of the fractured ribs had pierced one of his lungs. His death, which was caused by the injuries to his brain and lung, was ruled a homicide.”

Bauder and Dennis both told investigators that they were enraged over reports that Lopez had been harassing a 15-year-old girl named M.C., said court documents said; they claimed they were mad because Lopez allegedly wanted to sleep with her.

If convicted of first-degree murder, Bauder and Dennis could face a standard sentencing range of 20 to 26 years in prison, according to Donohoe.

The trial is expected to last up to seven weeks.

The defendants remain in jail on $1 million bail, as requested by Cheryl Snow, the Senior Deputy Prosecuting Attorney handling the case.

When asked about a tattoo on his arm, Bauder said it meant that he was a “Juggalo” meaning he was a fan and follower of the rap duo “Insane Clown Posse”
